1. Application
These terms apply to all quotes, assignments and agreements of Bestos, Alexandre Markelbachstraat 43, 1030 Schaerbeek, company number 0798.437.484, VAT BE 0798 437 484. By accepting a quote, the client accepts these terms.
2. Quotes
Quotes are based on the information the client supplies: address, type of building, year of construction, floor area and number of outbuildings. A quote remains valid for thirty days. If the site visit shows that reality differs materially from the information given, we get in touch before continuing. A surcharge is never applied unilaterally.
3. Performance of the assignment
The client ensures that all rooms to be examined are accessible at the agreed time, including the cellar, crawl space, attic, garage, storeroom, boiler room and outbuildings. Rooms that are not accessible are noted as such in the file and may give rise to a second visit, charged separately.
A non-destructive inventory describes only the materials that may pose a risk during normal use of the building. Enclosed asbestos is not traced. For a destructive inventory, the soundings are agreed beforehand.
4. Sampling and laboratory analysis
Where visual assessment gives no clear answer, a sample is taken and analysed by a laboratory accredited by the Federal Public Service Employment, Labour and Social Dialogue. The number of samples included in the price is stated in the quote. Sampling may cause limited, repairable damage to the material.
5. Prices and payment
All prices are exclusive of VAT unless stated otherwise. The fee OVAM charges for issuing an asbestos certificate is passed on in full. Invoices are payable within fourteen days of the invoice date. In the event of late payment, statutory interest is due by operation of law and without notice of default. Electronic invoicing runs through Peppol, under identification 0208:0798437484.
6. Delivery of the file
For a Flemish asbestos certificate, the file is entered into the asbestos inventory database and OVAM issues the certificate. The turnaround after the site visit is a few working days, longer when samples go to the laboratory. Bestos is not responsible for delays arising at OVAM or the laboratory.
7. Liability
Bestos performs the assignment as a best-efforts obligation, in line with the applicable inspection protocols and the state of the art. Our liability remains limited to the amount of the assignment, save in the event of intent or gross negligence. We are not liable for consequential loss, nor for damage arising from incorrect or incomplete information from the client, from inaccessible rooms, or from enclosed asbestos which by definition cannot be traced in a non-destructive investigation.
8. Cancellation
An appointment can be moved free of charge up to 48 hours in advance. In the event of cancellation within 48 hours, or where the expert is not given access on site, a flat-rate fee is charged for the reserved time and the travel.
9. Independence
Bestos does not carry out asbestos removal and has no commercial interest in the conclusions of a file. Advice is based solely on what was established on site.
10. Applicable law
Every agreement is governed by Belgian law. Disputes fall within the exclusive jurisdiction of the courts of the judicial district of Brussels.
